Terms of Service

These Terms of Service ("Terms") govern your access to and use of DELISH.IS, including our website, digital menu builder, QR code generator, online ordering tools, and related services (collectively, the "Service"), operated by DELISH.IS ("we", "us", or "our"). By creating an account, publishing a menu, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a restaurant account. You are responsible for providing accurate registration information, keeping your login credentials confidential, and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

2. Description of the Service

DELISH.IS lets restaurants, cafes, bars, and food trucks create digital menus, generate QR codes for tableside or takeaway ordering, accept online orders, and be discovered by nearby customers. We may add, modify, or remove features at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

3. Restaurant Owner Responsibilities

If you create and publish a menu on DELISH.IS, you are solely responsible for:

• The accuracy of menu items, prices, descriptions, allergen information, and images
• Fulfilling orders placed through your menu, including preparation, delivery, and refunds
• Complying with all applicable food safety, labeling, health, and business licensing laws
• Setting lawful and accurate pricing, taxes, and delivery fees
• Any disputes with customers arising from orders, quality, or service

DELISH.IS is a technology platform that connects restaurants with customers; we are not a party to the sale of food or goods between you and your customers.

4. Customer Orders

When you place an order through a menu hosted on DELISH.IS, you are contracting directly with the restaurant, not with DELISH.IS. Order accuracy, fulfillment, quality, refunds, and cancellations are the responsibility of the restaurant. Please contact the restaurant directly regarding an order; you may also contact us for help resolving platform-related issues.

5. Payments & Subscriptions

Certain features (such as premium menu tools) may require a paid subscription, billed and processed through our payment processor, Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel. Fees are non-refundable except as required by law or as otherwise stated at the time of purchase. You can cancel a subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.

6. Acceptable Use

You agree not to:

• Upload content that is false, misleading, defamatory, obscene, or infringes another's rights
• Use the Service for any unlawful, fraudulent, or harmful purpose
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, reverse engineer, or misuse data from the Service without authorization
• Impersonate any person or entity or misrepresent your affiliation

7. Content & Intellectual Property

You retain ownership of the menu content, images, and business information you upload ("Your Content"). By uploading Your Content, you grant DELISH.IS a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it as necessary to operate and promote the Service (for example, showing your menu to nearby customers). The DELISH.IS name, logo, software, and platform design are our property or that of our licensors and may not be used without our prior written consent.

8. Third-Party Services

The Service integrates with third-party providers, including Stripe (payments), OpenAI (AI menu scanning), WhatsApp Business API (order notifications), and mapping providers (location display). Your use of those integrations may also be subject to the applicable third party's terms. We are not responsible for the acts or omissions of third-party providers.

9. Suspension & Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time if you violate these Terms, create risk or legal exposure for us, or for any other reason at our reasonable discretion, with or without notice. You may stop using the Service and close your account at any time. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT MENU, PRICING, OR AVAILABILITY INFORMATION PROVIDED BY RESTAURANTS IS ACCURATE OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELISH.IS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.

12. Indemnification

You agree to indemnify and hold harmless DELISH.IS and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right.

13. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which DELISH.IS is established, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will first be attempted to be resolved informally by contacting us; if unresolved, it will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where applicable law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
